The Scofflaw module in Passport portal provides visibility into immobilization records (both generic and smart), as well as scofflaw and outstanding citations related to immobilization records.

Conditions

Each municipality creates ordinances and rules that determine when a parker becomes a scofflaw, thus making them eligible for immobilizations (e.g., boot or tow). Usually, these rules specify how many citations must be received and/or remain unpaid, or the maximum amount due for unresolved citations. These conditions could include one or more of the following:

• Citation Count

  • Example: A parker would be eligible for immobilization if they receive (and fail to pay) more than 3 citations within an 18-month period

• Dollar Amount

  • Example: A parker would be eligible for immobilization if they receive citations that total more than $500

• Days Outstanding

  • Example: A parker would be eligible for immobilization if they do not pay citations within 90 days of notification

Each municipality within a state could define different thresholds for boot/tow eligibility. Within Passport’s portal, the threshold for when a parker becomes a “scofflaw” is defined by the client rules.

Terminology

Since each municipality can define the conditions that determine when parkers become eligible for scofflaw status, the term might vary (e.g., "heavy hitter").

How Passport Generates Scofflaw Lists

Passport generates the scofflaw list once a day at 2:00 AM EST. 

Passport’s logic reviews all citations, registered owners, and LPNs for the past 10 years, then saves information including citation count, unpaid amount outstanding, number outstanding, LPNs, vehicle makes/models, name, birthday, matching criteria (LPN or person), etc. 

This logic only considers citations that are more than 30 days old (by default), unless a boot fee is associated with the citation. A person will be immediately removed from the scofflaw list after they pay their citations or when the amount paid puts them under the threshold for the scofflaw rules.

Note: A scofflaw rule applies to the registered owner of the vehicle rather than to the vehicle itself. 

Note: A person can only be added to the scofflaw list once a day. 

Note: Certain Fleet Vehicles are excluded from being added to a scofflaw list.

Example

Scenario: A city ordinance declares that a person who owes more than $200 in outstanding citations will be added to the scofflaw list and will be subject to immobilization. 

Example: A parker named Bob has received 4 citations on his car (LPN: ABC123). These citations total $150. Bob also owes $100 for 3 citations on his other car (LPN: XYZ456). Since Bob owes a total of $250 in outstanding citations, he is considered to be a scofflaw and will be subject to immobilization. 

If Bob changes his license plate or purchases a new vehicle, any additional citations would be applied to his current amount due.

Removal From Scofflaw List

A person is removed from the Scofflaw list immediately after they pay their citations or when their amount due falls below the threshold of the scofflaw rules. 

• Example: Using the previous example, Bob would need to pay at least $51 so his total amount due drops to $199, thus putting him under the $200 scofflaw threshold.

Note: If the vehicle has already been immobilized, the parker must pay all citations due.
